
Basically, a limitation period is the amount of time that a person has to start a legal proceeding before they lose their rights to do so.
The Limitations Act, 2002 establishes a basic limitation period of two years that applies to most legal proceedings started in Ontario Courts. For employment matters, there are other limitation periods that are important. For example, with respect to wages under the Employment Standards Act, 2000, the complaint must be made to the Ministry of Labour within 6 months from when the wages become due. As a further example, a person also must make a Human Rights complaint to the Ontario Human Rights Commission within 6 months of the alleged incidents.
One should immediately consult with an Employment Lawyer to determine the applicable limitation periods with respect to their matter so as not to lose their rights.
